Diverter Valve Leaking

When on tub setting (pushed in) water leaks into the wall. When the diverter valve is pulled out it does not leak. I could understand if the water was leaking out of the shower or tub spout but I don't understand how the water is getting out of the system to run down or what to do about it. As the tub has a skirt on it I can see the water drip from the front of the tub but cannot reach the taps or fittings. Hopefully tiles don't need to be torn out. Replaced the diverter valve about 4 years ago. Thanks in advance for any suggestions.
